Welcome to Elevate Fitness. By accessing our website, purchasing a membership, attending classes, or participating in personal training, you agree to the Terms of Service outlined below. These terms are designed to create fairness, clarity, and safety for all clients while protecting the integrity of our training environment

1. Membership Overview
Elevate Fitness operates on a month-to-month membership model. All memberships automatically renew unless written notice is submitted as outlined below.
1.1 Billing & Auto-Renewal
Memberships renew monthly on the same date each month.
Clients are financially responsible for all charges during the 30-day notice period.
1.2 No Refund Policy
All payments are non-refundable once processed.
Sessions are non-refundable but may be transferred to another person with written approval from Elevate Fitness.
2. Cancellation & Downgrade Policies
2.1 Cancellation
Membership cancellations require 30 days’ written notice.
Clients remain responsible for all charges during that 30-day period.
2.2 Downgrading Memberships
Downgrades also require 30 days’ written notice.
Changes will take effect at the start of the next billing cycle following the notice period.
3. Session Policies
3.1 Monthly Session Usage
Sessions must be used within 31 days of issue.
3.2 Rollover Policy
Unused sessions may roll over one additional month.
Any sessions not used by the end of that second month are forfeited automatically.
3.3 Session Transfers
Sessions may be transferred to another individual with written approval from Elevate Fitness.
No partial credits or cash value will be provided.
3.4 24-Hour Cancellation Rule
Training sessions and classes must be canceled at least 24 hours in advance.
Cancellations within 24 hours are charged in full.
4. Membership Pauses (Holds)
Memberships can be paused for up to 30 days.
A minimum of 14 days’ written notice is required.
After 30 days, the membership automatically resumes and billing continues.
Holds do not extend or pause the renewal date beyond the 30-day window.
5. Group Class Terms
5.1 Scheduling & Availability
Class schedule, format, and instructors are subject to change.
Class capacity limits may apply and reservations are recommended.
5.2 Conduct & Safety
To ensure a safe training environment:
Follow all instructor directions. Respect personal space, equipment, and other participants. Elevate Fitness may deny participation to anyone who poses a safety issue or disrupts the experience for others.
6. Health, Safety & Waiver of Liability
6.1 Health Representations
By participating in any Elevate Fitness service, you affirm:
You are in good physical condition. You have no medical condition that prevents safe exercise. You have reviewed and completed a PAR-Q where applicable.
6.2 Assumption of Risk
Physical activity involves inherent risks. By participating, you voluntarily assume all risks related to exercise and release Elevate Fitness, its employees, contractors, and affiliates from liability for:
Injury
Illness
Accidents
Personal property loss
This release applies to all in-person, virtual, and off-site sessions.
7. Personal Belongings
Elevate Fitness is not responsible for lost, stolen, or damaged personal items brought into the facility or left unattended.
8. Media Release
Unless otherwise requested in writing, you grant Elevate Fitness permission to use photos or videos taken during sessions or events for marketing, social media, and promotional purposes.
9. HSA/FSA Eligibility\
For eligible clients using HSA or FSA funds:
Proper documentation or Letter of Medical Necessity may be required. The client is responsible for confirming eligibility with their provider. All sessions purchased via HSA/FSA remain subject to standard Elevate Fitness terms.
10. Modifications to Terms
Elevate Fitness may update these Terms of Service as needed. Any changes will be posted on this page with an updated effective date.
11. Governing Law
These Terms are governed by the laws of the State of Texas.
